These Terms of Service ("Terms") govern your access to and use of the Fitted service ("Service"). Fitted is a brand operated by Hand Consulting LLC, a Texas limited liability company ("Fitted," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Plain English summary: You use Fitted to improve your resume. We use AI to help. The AI output is a starting point — review it before using it. We're not responsible for hiring decisions. You must be 18 or older to use the Service.
You must be at least 18 years old to use Fitted. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms. The Service is not directed at children under 13, and we do not knowingly allow anyone under 13 to use it.
Fitted is an AI-powered resume optimization tool. You upload or paste your resume and a job description. Our AI analyzes the gap between them, asks you questions about your experience, and generates an optimized resume incorporating your answers and relevant keywords.
Fitted is currently offered free of charge during its early access period. See Section 6 for details.
Fitted uses artificial intelligence to generate resume content. AI output is not guaranteed to be accurate, complete, error-free, or suitable for any particular purpose. You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it in a job application or any other context.
Specifically, you acknowledge that:
You retain all ownership rights to your resume and any other content you submit to Fitted ("Your Content"). By submitting Your Content, you grant Fitted a limited, temporary license to process it solely for the purpose of providing the Service to you within your session.
We do not store Your Content after your session ends. We do not use Your Content to train AI models. We do not share Your Content with third parties except as necessary to provide the Service (i.e., transmission to our AI provider).
You represent that you have the right to submit Your Content and that doing so does not violate any third-party rights.
You agree not to use Fitted to:
We reserve the right to suspend or terminate access for violations of these terms.
Fitted is currently provided to a limited number of advisors and individuals for evaluation purposes, free of charge. During this early access period:
Career advisors and professionals may use Fitted during the current early access period at no cost, on the at-will terms described in Section 6. Advisors may use Fitted to process resumes for their clients. This access is licensed for use by the individual or organization granted access and may not be shared or resold. When paid advisor plans launch, this section will be updated with subscription terms and users will be notified.
The Fitted name, logo, interface, and underlying technology are owned by Hand Consulting LLC and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from our proprietary materials without written permission.
The AI-generated resume output produced for you is yours to use. We claim no ownership over the specific resume content generated for your personal use.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FITTED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. FITTED DOES NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITTED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF EMPLOYMENT OPPORTUNITIES, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FITTED IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $1.00 USD FOR USERS ACCESSING THE SERVICE UNDER THE FREE EARLY ACCESS TERMS DESCRIBED IN SECTION 6.
Some states do not allow the exclusion of certain warranties or limitation of liability. In such states, the above limitations apply to the fullest extent permitted by law.
You agree to indemnify and hold harmless Hand Consulting LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your submission of false or misleading content.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.
Informal resolution: Before filing any legal claim, you agree to contact us at hello@fittedlab.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action.
Fitted integrates with third-party services including Anthropic (AI processing) and Cloudflare (infrastructure). These services are governed by their own terms and privacy policies. Fitted is not responsible for the practices of these third parties.
We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may update these Terms from time to time. We will notify users of material changes by updating the effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fitted regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
